A
FAITH OF A COMMON MAN – A MOCKERY FOR THE POLITICIANS
The judiciary is the branch of government
that deals with interpretation of a nation’s laws, resolution of legal
conflicts, and judgments for violations of the law. Our judicial system is
separate from the nation’s legislative body i.e. the Parliament, which creates
or abolishes the nation’s laws as part of the nation’s progress. It is indeed
very shameful that today, the work of the Legislative bodies is being done by
the Indian Judiciary. The work that should have been done by legislatures is
now being enforced by courts thus blurring the line of difference between
legislative body and judicial body thus resulting into weakening of a democratic
governance.
The role of the judiciary in is to assist
in delivering justice to realistic situations and provide an impartial judgement
as well as being the ‘CARE TAKER’ of the constitution. Where, on one hand the
judgement of judicial bodies is respected and honoured by every COMMON MAN, there
on the other hand it is mocked and made fun of by most of our honoured respected
senior politicians publically. Have they no respect for THE COURT OF LAW? They
are so intrepid that they do have no fear of CONTEMPT OF COURT too. Holding
such high profile posts, no leader has the right to pass any wrong message to
the nation. They have no right to encourage rapes and give it a classification
of just a casual mistake done by boys? The rape victim experiences a complete
disruption of her life responding to the fear of
death. Her life is fully shattered and
faces a difficult time overcoming
shock and disbelief. If the assault was particularly terrifying or brutal, it
is on the more difficult and she may experience an extreme shock response too. But
for a Minister, it is just how he describes it: "Boys and girls
....later they had differences, and the girl went and gave a statement that I
have been raped. And then the poor fellows, three of them have been sentenced
to death. Should rape cases lead to hanging? They are boys, they make mistakes.
Two or three have been given the death sentence in Mumbai. We will try and
change such laws...we will also ensure punishment of those who report false
cases."
Has he no respect for Women? Has he no
shame? What kind of society are we living in which allows crimes against women
to be excused and deprived of justice referring to just accidental liberty and
not considering it as a grave offence which has the merits for capital
punishment? Putting a question mark on decision of judiciary in open public – What
does this signify?
What's more, political parties give a
political colour to the tragedy by indulging in blame games after being
exposed. There is no accountability each time a crime of this nature is
committed. The senior
leaders are all united in criticising the functioning of the judiciary. They are regularly
passing wrong remarks and even mocking at the Court of Law by addressing that
the courts today have no other work except granting stay in all Cases. What
kind of a statement is this? Isn’t this aloofness showing that leave away the
fear, they have no respect for our Judiciary System?
No doubt, we are the proud citizens of India
and love boasting of its development. But what exactly the truth is? It is
ground reality that today, India is a VICTIM of defeated democracy, corrupt
bureaucracy, a distorted system and a deformed polity. It is indeed very
disgraceful that people like senior police officers, bureaucrats, politicians,
judges, and school administrators who should have been at the forefront of
efforts to indict the culprits, have proved themselves to be worse culprits by
colluding with each other to perform all sorts of crimes.
The time has come for a paradigm modification in our thinking and
deeds so that we can live in this country with Dignity and Respect.
