 Special Status of Jammu & Kashmir
(Article 370)


Under Article 1 of the Indian Constitution, the state of Jammu and Kashmir is a constituent state of Indian Union and its territory forms integral part of the territory of India.

Article 370 in part XXI of the Constitution grants a special status to Jammu & Kashmir (J&K). Accordingly, all the provisions of the Constitution of India do not apply under the same part (XXI) of the Constitution and apart from J & K, ten other states of the Indian Union also enjoy special status under part XXI.

What was the need and why was Article 370 made?

With the end of the British paramountcy, the state of J&K became independent on 15th August 1947. Initially its ruler Maharaja Hari Singh, decided not to join India Pakistan and thereby remain independent. On 20th Oct. 1947, the Azad Kashmir Forces supported by the Pakistan army attacked the frontiers of the state. Under this unusual and extraordinary political circumstances, the ruler of the state Maharaja Hari Singh decided to accede the state to India. Accordingly the “INSTRUMENT of ACCESSION of JAMMU & KASHMIR to INDIA” was signed by Pandit Jawaharlal Nehru and Maharaja Hari Singh on 26th October 1947. It was accepted by then Governor of India Lord Mount Batten, on 27th October 1947.

In pursuance of this commitment Article 370 was incorporated in the Constitution of India. It clearly states that the provisions with respect to the state of J&K are ONLY TEMPORARY AND NOT PERMANENT. It became operative on 17th November 1952.

The provisions of Article 1 (declaring India as a Union of state and its territory) and this Article 370 are applicable to the state of J&K.

The other provisions of the Constitution can be applied to the state with such exceptions and modifications as specified by the President in consultation with the state Government or with the concurrence of the State Government.

The President can declare that Article 370 ceases to be operative or operates with exception and modifications. Therefore Article 370 makes Article 1 and Article 370 itself applicable to the state of J&K at once and authorizes the President to extend other articles to the state.

The state emergency (President’s Rule) is applicable to the state of J&K. In 1986, the President’s Rule was imposed in the state for the first time.

The special leave jurisdiction of the Supreme Court, Election Commission and the Controller and Auditor General are applicable to J&K whereas the High Court of J&K can issue writs only on the enforcement of the fundamental rights and not for any other purpose.

J&K AUTONOMY RESOLUTION REJECTED BY THE CENTER:

On June 26, 2000 in a historic move, the J&K legislative assembly adopted by voice vote J&K autonomy resolution accepting the report of the state autonomy committee, recommending greater autonomy to the state.

The Assembly sought the following:

1.     The word “Temporary” in Article 370 to be substituted with “Special”
2.     Only Defence, Foreign affairs, Communications and ancillary subjects to be with the centre.
3.     Article 356 not to apply to J&K.
4.     Election Commission of India to have no role.
5.     J&K Assembly to have final say on central role in case of external aggression/ internal emergency.
6.     No room for All India Civil Services (IAS, IPS & IFS) in J&K.
7.     Governor and Chief Minister to be called Sadre – Riyasat and Wazir – e- Azam.
8.     Separate charter of fundamental rights for J&K.
9.     Parliament’s and President’s role over J&K to be sharply curtailed.
10.                         No special leave to appeal by the Supreme Court.
11.                        No special provisions for the Schedule Castes/ tribes and/ backward classes.
12.                        Centre to lose adjudication rights relating to Interstate – rivers or river valleys.
13.                        No jurisdiction of the Supreme Court in appeals from the High Court of J&K in civil and criminal matters.
14.                        Parliament not to be empowered to amend the Constitution and procedure with respect to J&K.

On 14th July 2000 the Union Cabinet, rejected this Autonomy Resolution of J&K Assembly dated 26th June 2000, as unacceptable though at the same time committing itself to a greater devolution of powers to all states. The Cabinet formed this resolution was essentially unacceptable as it was a plea for restoration of pre – 1953 status to the state and it would set the clock back and reverse the natural process of harmonizing the aspirations of the people J & K with the integrity of the nation.

The cabinet wanted the people and the State Government to join hands in the endeavour to address the real problem facing the state: to root out INSURGENCY and cross border TERRORISM, and to ensure ACCELERATED DEVELOPMENT.

Our new Government is bold enough to take up this matter on top priority with merit basis because it is well aware that the erstwhile regime or the current one will never be interested to remove it for their unwarranted gains as it will help not only the Development of J&K but also the people of J&K will be independently moving towards the path of progress in the fields of economy, industrialisation, education and medical etc.  as presently tourism alone is the backbone of the Kashmiri people to earn their livelihood.

Let us all unite and come together to support this and organise a healthy and constructive debate on J&K that whether Article 370 should be removed from the Constitution or not? We must follow the realistic approach towards the betterment of Kashmiris and not that such an important and primitive issue be taken away from us by the clutches of few self-centered politicians.

Why our fellow citizens should be deprived of their rights to all the various facilities just because of the vested interests of few politicians who have no thought for the common people. It is therefore the need of the hour that we be well aware of the real facts and prove to everyone that, though we may be a nation of different cultural heritages and different caste and creeds but there is inbuilt and inborn patriotism and heroism within us for Our Country.

SOW THE SEEDS OF LOVE

"...To Sow the Seeds of Love is to find opportunities to serve every day, every moment of our lives in terms of what we can do for others..."


We build a house and decorate the surroundings with creative landscapes and beautifully manicured gardens to keep the area neat and clean so that the surrounding is fresh and healthy. The family then, spreads its wings amongst the neighbours, holding different type of professions, belonging to different castes and different states, by a strong spirit of love forming a wonderful society, ready to help each other always at the hour of need. Similarly if the surrounding is unhealthy and unhygienic, the place stinks and looks very shabby and dirty giving it an ugly look. Not one single moment can anyone stand there including you?


Therefore it can be clearly observed that “LOVE” is a man’s biggest tool of success that can change or reform any person in the same manner when a parent grooms up his child into a perfect human being with immense love and care and he even at times scold and punishes the child if required.

It is love that speaks out for justice and protests when harm is being done. It is love that points out the consequences of hurting oneself or others and allows room for anger, grief or pain to be expressed and released. It make us care for others to whom we get connected as love, itself is inherently compassionate and empathic. It is indeed a true nature of love that it cannot be manipulated or restrained for love honours the sovereignty of each soul and is its own law.

Today “LOVE” is getting extinct and honestly I feel that we are living in a world of people who are habituated to think only about themselves. People have become selfish and practical and in certain cases seem to be losing human values too. The other thing that requires thought is the knowledge of maintaining a good relationship is vanished. We should be strong enough to communicate and resolve an issue rather than withdraw from it and then blame others for their failed results. No! As long as you are willing to give love then you should be able to expect it in return, if not then move on. But a life without love would be a gray and sad entity certainly.

Each of the residents have their own culture and faith but one thing is common among all is that “LIVE IN PEACE AND RESOLVE EACH OTHER’S PROBLEMS."
 
Love.... love requires chemistry and spark, and definitely in acts of kindness, generosity and self-sacrifice because when you meet someone, it just is not there and even if it is there, the spark doesn't grow into a fire because one or both of the participants are afraid for that to really happen. Remember, love is that weapon which can never ever hurt anyone, although it may rate dearly. The paradox of love is that it is supremely free yet attaches us with bonds stronger than demise. It cannot be bought or sold; there is nothing it cannot face and love is life's greatest sacred sign.

Poets and authors have tried to define love for centuries but are still unable to describe its characteristics fully and this love is also a major purpose for living for that connection is inherent in all that we do because without love, we cannot survive as most of us know intuitively as nothing is more mysterious in a human mind except that when we see something different happening, it leaves us feeling lost and confused.

Similarly is with our neighboring countries. Our country is that beautiful house with the SAARC countries as our neighbours. No matter how wrong they may be, if Mr. Modi has taken a step ahead and trying to maintain a cordial relationship with them, it is indeed too great a step to applaud because it is a bright start in which we all must support him and just not sit and criticize for the sake of doing so.

It is high time, we made a stand and shook up the views of the common man as anything is possible when you're sowing the Seeds of Love. All the efforts go in vain when negative debates are held in a good action. Freedom is given to all but certain barriers should also be drawn. Why I say this is because, Mr. Modi has taken a very good and bold step to invite and talk with the Prime Minister of Pakistan. But the debates held on most of the television channels are very unhealthy. If we keep poking them, how can we expect o positive response from them? We are a peace loving nation and Mr. Modi has walked ahead with this message "Live and let live".

It does not mean that we should compromise on their wrong doings, definitely we should not compromise with the peace and harmony of our country, but that also does not mean that a chance should not be given in a new way by spreading the wings of love and sowing its seeds at the borders so that the environment becomes dynamically fresh and healthy.

Media channels to hold debates on peace, development and other social economic issues because from past so many years such debates have done nothing but instigated the feeling of enmity more.

Now when the future of the country is bright and beautiful, then we all should think positive, see positive and do positive.
I personally believe we can change the world as no project is too small or insignificant, especially to those it benefits. My hope is that these seeds of service will blossom and live on for countless generations to come.

A FRESH START

A FRESH START


Escalation in Prices, corruption, unemployment and different kind of scams etc. has made the life difficult to survive his living for every individual Indian. We all have already lost a huge amount in scams which could have been otherwise utilized for the various benefits for the common man of the country. Because of the ill governance from past regime, the apathy of a common man cannot be described in words as we had lost the zeal to progress and is continuously struggling to survive and earn our livelihood as there is a wide gap between the faith, trust, belongingness and harmony,  not only among the different communities but also between a common man and the government. People are full of unhappiness, frustration and depression and have accepted all this as their fate which  has forced them to incessantly slog on and on. This is the reason why so many crimes, suicides and evil activities are taking place today.

Due to all the above reasons businesses have slacked down affecting the overall economic and industrial growth of the country. The rise and development of any country  has to be a combined effort to walk towards a new horizon as it is a chain process and cannot be a process of once or any one working alone. But it is no use crying over spilt milk and now the people have seen a ray of hope in a new face, Mr. Narender Modi, who has to prove himself at a national level. The people have deposed their confidence in him and this hope has forced them to reverse their decision through ballot paper, the back bone of our democracy.


They are overexcited and filled with new strengthened energy which will be beneficial to the country. The time has now come to bless our motherland with the fragrance of love, affection, truthfulness and honesty between the present regime and a common man in order to walk towards the path of a new sunshine paving the way for an improved bright future.

Where, there was negativity and people seemed to be just living without any interest thus making their lives dull and monotonous, there today, the aura around is fresh and full of positive passion and enthusiasm where each single person looks up with hope and confidence towards the new government.

A little more persistence, a little more effort, and what seemed hopeless failure will definitely turn to glorious success. You may not always have a comfortable life and you will not always be able to solve all of the problems at once but don't ever underestimate the importance you can have because the present has shown us the path of success once forgotten.   

For all the above factors “Development” is the only mantra to scale over the menace of unemployment, growth, rise in price index, inflation etc. As the rise of a common man results in the rise of any nation, we should all leave the past behind and move forwards towards a fresh beginning, encouraging each towards the new beginning.

We should not expect wonders instantly from this new Government and all the controversial matters relating to religion, cultural heritage and border disputes etc. should be kept aside for the time being to give the new regime a chance for good governance as we have to prove that we are very peaceful and calm by nature for a certain period of time or otherwise we are as powerful as a blast of nuclear explosion which we have already proved through our ballot in a Democratic way, so now we are ready to give reasonable time to the new Government to prove their worth.

Imagine the future of our country where no one is poor, striving for his livelihood and the life of every citizen of our country is comfortable and peaceful. I know it is a dream, but it can definitely come true if we all unite and cooperate with the Government to give it a fair chance for excellent governance and march towards the path of great future wherein we will not only be known as “VISHWA GURU” but also shining as “KOHINOOR” on the map of the world.

We all think eating fruits means just buying fruits, cutting it and just popping it into our mouths.  It's important to know how and when to eat. Most of us are used to eating fruits after meals. BUT

FRUITS SHOULD BE EATEN ON AN EMPTY STOMACH because then it will play a major role to detoxify your system, supplying you with a great deal of energy for weight loss and other life activities. 

FRUIT IS THE MOST IMPORTANT FOOD.

Breakfast of two slices of bread and a slice of fruit. The minute the fruit comes into contact with the food in the stomach and digestive juices, the entire mass of food begins to spoil and turns to acid. 
So please eat your fruits on an *empty stomach* or one hour before meals! Many people complain— that every time after eating watermelon he/she burps, after eating a banana he/she feels like running to the toilet etc. — actually all this will not arise if the fruit is eaten on an empty stomach. The fruit mixes with the putrefying other food and produces gas and hence a person is uncomfortable. Researches have proved that greying hair, balding, nervous outburst and dark circles under the eyes can be avoided if one takes fruits on an empty stomach.
It is completely ridiculous that some fruits, like orange and lemon are acidic, because, according to Dr. Herbert Shelton who has deeply researched in this matter, all fruits become alkaline in our body.  Any person following the correct way of eating fruits shall have the secret of beauty, longevity, health, energy, happiness and normal weight. When you need to drink fruit juice, then drink only fresh fruit juice and not the tinned cans ones and never drink juice that has been heated up. Avoid eating cooked fruits since you only get the taste and not the nutrients at all for cooking destroys all the vitamins. 

Every individual should try to go on a three day fruit diet to cleanse your body because fruits is the best cleansing agent of the body. Just eat fruits and drink fruit juice throughout the three days. It is better eating a whole fruit than drinking juice and if you should drink the juice, drink it mouthful by mouthful slowly and let it mix with your saliva before swallowing it. 
We follow so many beauty tips, go to parlours to look the best but to the best of one’s knowledge, it only improves it externally and that too on temporary basis. But if we just follow the right way of eating fruits, you yourself will be surprised when your friends tell you how radiant you look!  

Each fruit has its own benefits such as:-

LEMON: Lemons and limes are excellent sources of vitamin C and a good source of folate. It contains no saturated fats or cholesterol, but is rich in dietary fibre. Lemon is one of the very low glycemic fruits. Its citric acid is a natural preservative that aids digestion and helps dissolve kidney stones. It also helps the human body develop resistance against infectious agents and scavenge harmful, pro-inflammatory free radicals from the blood.

 KIWI: Tiny but mighty. This is a good source of potassium, magnesium, vitamin E & fibre. Its vitamin C content is twice that of an orange.

Honour Killing

“Like all social evils, unless society shuns these practices, the police and judiciary alone cannot save women who want to break free from arranged and abusive marriages.”

Honour killing (also called a customary killing) can be defined as the homicide of the member of a family or social group by other members due to the belief of the perpetrators that the victim has brought dishonour upon the family or community. This is a death sentenced by family or society members to a man or woman for marrying against parent’s wish, having extra-marital or pre-marital affair, marrying outside one’s caste or within same gotra etc., in order to protect the social status and honour of the family. The dishonour perceived in this kind of killings may be a result of behaviours as trivial as dressing in a manner unacceptable to the family or community, or having a non-sexual relationship that is perceived as inappropriate. The honour killing practiced in modern history seems to have gained momentum since the partition of India in 1947. The tradition was first viewed most brutal and horrible during 1947 and 1950, when women were forcefully killed to protect the family’s honour for a lot of forced marriages and rapes were causing women from India to marry men from Pakistan and vice-versa.
Mostly the method of honour killing is adopted when a girl goes against the wishes of her family and marries a guy who does not belong to her own community. In some of these cases, both the boy and the girl are killed either secretly by the family members and even openly claiming that the respective boy or girl has bought disgrace and disrespect to the family and to the society or community as a whole. The socio-political environment during this period caused women to be made victims for humiliation among conflicting communities leading to the humiliated families killing women of their own families. This practice is not only prevalent in India, but is widespread worldwide including North and South America, Africa, Turkey, Palestine, Pakistan etc.
There are various misconceptions regarding the practice of honour killing. The first misconception about honour killing is that this is a practice that is limited to the rural areas. The truth is that we cannot isolate honour killings to rural areas only, though one has to admit that majority of the killings take place in the rural areas. It has also been seen recently that even the metropolitan cities like Delhi and Tamil Nadu are not safe from this crime because some honour killings have been reported from Delhi and in Tamil Nadu too. The second misconception regarding honour killing is that it has religious roots. Inter-caste marriages are also one of the major causes of such crimes. Engaging in heterosexual, sexual acts outside marriage, or even due to a non-sexual relationship perceived as inappropriate, and engaging in homosexual acts is the third biggest misconception.

Violence against women takes many forms: verbal abuse and physical beatings; being stoned or burned; disfigurement by acid; threats; false imprisonment; sexual abuse; forced marriages, in which the female is threatened to enter a marriage against her own will. It is clearly seen that there is no religious backing or religious roots for this heinous crime. Women and girls are killed at a much higher rate than men. Even if a woman commits adultery, there have to be four male witnesses with good behaviour and reputation to validate the charge. Furthermore only the State can carry out judicial punishments, but never an individual vigilante.

This practice is mostly common in uneducated families where the ancient old tradition where women have no rights to challenge the decision taken by the family members keeping in mind the culture, family and their so called religious values. Another cause responsible for killings is the dispute between girls and their parents on marriage and control, specially the marriage outside one's own caste. The notion of marrying outside one's own caste brings dishonour to the family which is responsible for axing their daughter, to death, by her own father or brother. The basic cause of this social menace is the tradition of caste and control over a women's body and the patriarchal mind set. Because of this in most of the cases the honour killing is done by girls' family. The notion of the father as dictator with an iron-fisted grips on the lives of his children specially his daughters regrettably persists in many countries around the world. And, the father believes that if his children stray, especially in sexual matters, the father is entitled to punish them even unto death. This barbarism carries the name Honour Killing.
 In India unfortunately 'honour killing' has become common place. The Supreme Court observed, "to kill or physically assault a young man /woman who marries against their wishes is wholly illegal.” If someone is not happy with the behaviour of his daughter or other person, the maximum one can do is to cut off social relations with her/him there is nothing "honourable" in 'honour killings.' The government of India has formulated laws against honour killing but still this inhuman practice exists. Such delinquents should be punished as ruthlessly as possible and even capital punishment should be pronounced to them so that they realize that how painful and cruel death is to any individual that they kill.
The United Nations Population Fund estimates that approximately five thousand women are killed each year for "dishonouring" their families.  UNICEF calculated that about two-thirds of all killings in Palestinian territories are honour-killings. 

The leniency towards honour-killings is in practice in Arab countries also.  In the territories ruled by Palestinians, under Article 340, men are completely exempted from liability for honour-killing. This article 340 of the Penal Code of Jordan, provides for an exemption from penalty if a man kills his wife or female relative after finding her “committing adultery with another.”  It provides for a reduction in penalty if a man kills his wife or female relative after finding her “with another in an unlawful bed.” In another section, a "lesser penalty" is imposed.  Similarly, Article 548 of the Penal Code of Syria also provides an exemption from penalty if a man kills or injures his wife or female after finding her committing adultery or other “illegitimate sexual acts with another.”  The law also provides for a reduction in penalty for a man who kills or injures his female relative after catching her in a “suspicious state with another.” Even more, according to the Iran Penal Code, Article 630, a husband is allowed to murder his wife without penalty if he suspects her of adultery. In some countries such as Jordan, Morocco and Syria, “honour crimes” are also legally sanctioned and defence of the family honour is considered a mitigating factor.

The way in which legislation in various countries awards lesser punishment in cases where the victim is considered to have “provoked” the crime by violating cultural norms is also of concern. In many countries, there are few available resources to protect women and victims are placed in state custodial or correctional institutions for example in Jordan, for example, there is no women’s shelter.  There are only state-run women’s prisons where women are incarcerated for their own safety - to be protected from their own families.  Ironically, their release can only be secured by a male relative. 

Voices have also been raised to reign in the 'khap panchayats', self-elected village councils comprising male village elders who perpetuate values that, in turn, covertly endorse these killings in the name of saving the 'family's honour'. Like the Taliban in Pakistan and Afghanistan, the khaps have attained notoriety by issuing diktats on dress code for women and demanding a ban on the use of cell phones by young girls and women. In India recently, a group of khap panchayats filed a document before the country’s highest court saying they had been wrongly charged for encouraging honour killings in rural India. Earlier, a women’s rights group, Shakti Vahini, had petitioned the Supreme Court seeking a direction to the government to be more proactive when ‘honour killings’ are carried out. They blamed the khap panchayats for endorsing patriarchy, which reinforced the subjugation of women in society and the resultant ‘honour killings’.

Is the society more important than your children? When questioned all will say that children are most important, but in such cases, the reality is completely different. These people who kill their children are actually murderous hooligans who are only concerned about their sham status and position in the society and nothing else. Such people should be termed as criminals as they are far more dangerous than the terrorists. Terrorists kill people who are unknown to them while these fanatics are a part of that heartless group who can kill anyone for a baseless reason and name it as honour killing.
As a human being each and every individual has the right to live his or her own life according to their own wishes. After attaining the age of adulthood by both, the girl and the boy respectively, the family has no right to force them into marriage or any other act if they are unwilling to do so. If an individual that he or she wants to marry according to their wishes, their wishes feels should be accepted as well as appreciated in the society. In fact, parents only wish to see their children happy because every parent’s contentment lies in the happiness of their child.  But for a number of families, their status and position in the society is far more important that they do not even mind killing or sacrificing their own blood just to maintain their farce pride and prestige.

What can we do to prevent such a thing from happening? Firstly, the mentality of the people has to change which means that the mentality of the parents has to change and they should accept their children’s wishes regarding in the choice of their life. We should broaden up our minds and come out of Casteism, Gotra etc. Secondly, we need to have extremely strict laws to tackle such kinds of killings as this is a crime which cannot be pardoned for humans do not have the right to give death sentences of innocent fellow humans.

The efforts taken by some very active women's organizations and international units attempting to curb abuse of and violence against women to bring awareness to the cultural, and sometimes religious, norms, laws, and practices that have created and preserve these conditions are too small. The way this violence is prevalent in many countries in the world, strong and stringent laws should be enforced to curb such monstrous crimes because at the base of this violence is the farce concept of honour, which women supposedly embody, because of their lack of education and empowerment as women affected by this concept have rarely been able to challenge the nature and consequences of it. What is needed is a large-scale attack by national governments and international organizations. 

We all should strictly stand against the social ails that act as a portico to the scalp roots of the country. Our mission should be to target the victims and provide aid and support in whatever way possible. Contributing for a social and ethical cause.
